Terms of Service for Domain Registration Services

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Registrant", "you", or "your") and DotWee Limited ("DotWee", "we", "us", or "our"), an ICANN-accredited domain name registrar. By registering a domain name, creating an account, or using any of our services, you agree to be bound by these Terms, our Privacy Policy, and all other policies referenced herein.

1. Definitions

In these Terms:

  • AuthInfo Code means the authorization code (also called EPP code or transfer code) required to transfer a domain name between registrars.
  • Domain Name means an alphanumeric designation registered in the Domain Name System (DNS).
  • ICANN means the Internet Corporation for Assigned Names and Numbers.
  • RAA means the 2013 Registrar Accreditation Agreement between ICANN and DotWee.
  • RDAP means the Registration Data Access Protocol, the standard for querying domain registration data.
  • Registrant means the individual or organization in whose name a domain is registered.
  • Registry means the organization that maintains the authoritative database of domain registrations for a given TLD.
  • TLD means Top-Level Domain (e.g., .com, .net, .io).
  • UDRP means the Uniform Domain-Name Dispute-Resolution Policy.
  • URS means the Uniform Rapid Suspension System.
  • WHOIS means the protocol and service for querying domain registration data.

2. Services

DotWee provides the following domain name services:

  • Domain Registration: Registration of new domain names across supported TLDs.
  • Domain Renewal: Renewal of existing domain registrations.
  • Domain Transfer: Transfer of domain names to or from DotWee.
  • Domain Restoration: Recovery of expired domains during the redemption grace period.
  • Nameserver Management: Configuration and management of DNS nameservers.
  • WHOIS Privacy: Redaction of personal data from public WHOIS/RDAP where permitted by registry policy.
  • Domain Lock: Security features to prevent unauthorized transfers.

Services are subject to availability, applicable registry policies, and the terms of our accreditation agreements. Not all features are available for all TLDs.

3. Eligibility and Account Registration

3.1 Eligibility. To use our services, you must:

  • Be at least eighteen (18) years of age or the age of legal majority in your jurisdiction;
  • Have the legal capacity to enter into binding contracts;
  • Not be prohibited from using our services under applicable law;
  • Provide accurate and complete registration information.

3.2 Account Security. You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • All activities that occur under your account;
  • Notifying us immediately of any unauthorized use or security breach;
  • Ensuring your contact email address remains current and functional.

3.3 Account Information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Registrant Obligations

4.1 Data Accuracy. In accordance with ICANN RAA Section 3.7.7, you represent and warrant that:

  • All information provided during domain registration is accurate and complete;
  • You will promptly update your registration data within seven (7) days of any change;
  • The domain name registration will not infringe upon or violate the rights of any third party;
  • The domain name will not be used for any unlawful purpose.

4.2 WHOIS Data Reminder Policy (WDRP). Per ICANN requirements, we will send you an annual reminder to review and update your WHOIS data. You must respond within fifteen (15) days to confirm accuracy or update any incorrect information. Failure to respond may result in domain suspension.

4.3 Registrant Contact Verification. You must verify your registrant email address within fifteen (15) days of domain registration or when you change the registrant email. Failure to verify may result in domain suspension until verification is completed.

4.4 Compliance with Policies. You agree to comply with:

  • All applicable ICANN policies, including the RAA and Consensus Policies;
  • All applicable registry policies for your TLD;
  • All DotWee policies, including our Abuse Policy;
  • All applicable laws and regulations.

5. Payment Terms

5.1 Prepaid Balance. DotWee operates on a prepaid wallet system. You must maintain sufficient account balance to cover the cost of domain registrations, renewals, and other services before they can be processed.

5.2 Pricing. Prices for domain services are published on our website and may vary by TLD. We reserve the right to change prices at any time; however, price changes will not affect services already paid for.

5.3 Non-Refundable Fees. Domain registration, renewal, transfer, and restoration fees are generally non-refundable once the transaction has been submitted to the registry. This includes:

  • Registration fees for successfully registered domains;
  • Renewal fees once the renewal is processed;
  • Transfer fees once the transfer is initiated;
  • Redemption/restoration fees.

5.4 Payment Methods. We accept payments via credit card (processed by Stripe) and cryptocurrency (processed by Heleket). All payments are processed by third-party payment processors subject to their terms of service.

5.5 Taxes. Prices are exclusive of applicable taxes. You are responsible for any taxes, duties, or other governmental charges associated with your use of our services.

6. Domain Lifecycle

Domain names follow a defined lifecycle including registration, expiration, grace period, redemption period, and deletion. Full details are provided in our Domain Lifecycle and Redemption Policy.

6.1 Expiration Notices. In compliance with ICANN's Expired Registration Recovery Policy (ERRP), we will send expiration reminder emails at least:

  • Thirty (30) days before expiration;
  • Five (5) days before expiration;
  • Five (5) days after expiration.

It is your responsibility to ensure your contact email is current and capable of receiving these notices.

6.2 Auto-Renewal. You may enable auto-renewal for your domains. If enabled and your account has sufficient balance, we will attempt to renew your domain before expiration. Auto-renewal does not guarantee successful renewal if your account lacks sufficient funds.

7. Domain Transfers

Domain transfers are subject to ICANN's Inter-Registrar Transfer Policy and our Domain Transfer Policy.

7.1 Transfer Lock. Newly registered domains and domains recently transferred to DotWee are subject to a sixty (60) day transfer lock per ICANN policy. You may request removal of this lock where ICANN policy permits.

7.2 Outgoing Transfers. We will not unreasonably deny or delay outgoing transfer requests. You may transfer your domain to another registrar at any time, subject to ICANN-approved restrictions.

8. ICANN-Mandated Provisions

8.1 Consent to ICANN Policies. By registering a domain name through DotWee, you agree to be bound by:

  • The terms and conditions of the applicable Registry Agreement;
  • ICANN's Consensus Policies, as amended from time to time;
  • ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP);
  • ICANN's Uniform Rapid Suspension System (URS) for applicable TLDs.

8.2 Dispute Resolution. You acknowledge and agree that:

  • Domain name disputes may be subject to the UDRP or URS;
  • You will submit to proceedings under UDRP or URS if a complaint is filed;
  • If a decision is rendered against you, your domain may be transferred or cancelled;
  • Court proceedings under UDRP Section 4(k) must be filed within ten (10) business days of a decision.

8.3 Data Escrow. In compliance with ICANN requirements, registration data is escrowed with an ICANN-approved escrow provider to ensure continuity of domain services.

8.4 Registrant Rights. As a domain name registrant, you have specific rights under ICANN policy. Please review the ICANN Registrant Rights and Responsibilities document.

8.5 ICANN Compliance. We are required to comply with ICANN policies and may take action on your domain (including suspension) to comply with ICANN requirements, court orders, or law enforcement requests.

9. Acceptable Use

9.1 Prohibited Activities. You may not use our services or any domain registered through DotWee to:

  • Distribute malware, viruses, or other harmful code;
  • Conduct phishing, pharming, or other fraudulent activities;
  • Operate botnet command and control infrastructure;
  • Distribute child sexual abuse material (CSAM);
  • Engage in spam or unsolicited bulk email;
  • Infringe intellectual property rights;
  • Violate any applicable law or regulation;
  • Engage in DNS abuse as defined by ICANN.

9.2 Abuse Response. We reserve the right to suspend or cancel domain names used for prohibited activities. Our abuse handling procedures are detailed in our Abuse Policy.

10. Intellectual Property

10.1 Your Representations. By registering a domain name, you represent that:

  • The registration does not infringe any trademark, service mark, or other intellectual property right;
  • You are not registering the domain in bad faith;
  • You will not use the domain to infringe the rights of others.

10.2 UDRP and URS. If a trademark holder files a complaint under the UDRP or URS, you agree to participate in the dispute resolution process. If a decision is rendered against you, the domain may be transferred to the complainant or cancelled.

10.3 Our Intellectual Property. DotWee, our logo, and our service marks are the property of DotWee Limited. You may not use our marks without prior written consent.

11. Service Availability

11.1 Availability. We strive to maintain high service availability but do not guarantee uninterrupted access to our services. Scheduled maintenance will be announced in advance when possible.

11.2 Force Majeure. We are not liable for any delay or failure in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, network failures, or registry outages.

12. Limitation of Liability

12.1 Exclusion of Damages. To the maximum extent permitted by applicable law, DotWee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to these Terms or your use of our services.

12.2 Cap on Liability. Our total cumulative liability to you for any claims arising out of or related to these Terms or our services shall not exceed the amounts you have paid to DotWee in the twelve (12) months preceding the claim.

12.3 Essential Purpose. The limitations in this section apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless DotWee, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of our services;
  • Your domain name registration or use;
  • Your violation of these Terms;
  • Your violation of any applicable law or third-party rights;
  • Any dispute regarding domain ownership or intellectual property.

14. Disclaimers

14.1 As-Is Service. Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14.2 No Guarantee of Registration. We do not guarantee that any domain name will be successfully registered, renewed, or transferred. Domain availability is subject to registry policies and first-come, first-served allocation.

14.3 Third-Party Services. We are not responsible for the acts or omissions of third parties, including registries, payment processors, or other service providers.

15. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated to you via email at least thirty (30) days before taking effect. Your continued use of our services after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our services and may transfer your domains to another registrar.

16. Termination and Suspension

16.1 Termination by You. You may close your account at any time. Domain names will remain registered until their expiration date unless you transfer them to another registrar.

16.2 Termination by Us. We may suspend or terminate your account and services if:

  • You breach these Terms or any applicable policy;
  • You provide false or inaccurate registration information;
  • You fail to respond to WDRP or verification requests;
  • Your domain is used for prohibited activities;
  • We are required to do so by law, court order, or ICANN;
  • Your account shows fraudulent activity.

16.3 Effect of Termination. Upon termination, you remain responsible for all fees incurred prior to termination. Provisions that by their nature should survive termination shall survive, including limitation of liability, indemnification, and dispute resolution.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law provisions. This choice of law does not affect your mandatory consumer protection rights under the laws of your country of residence.

18. Dispute Resolution

18.1 UDRP/URS Exclusion. This section does not apply to domain name disputes subject to the UDRP, URS, or other ICANN dispute resolution procedures, which are governed by their respective policies.

18.2 Negotiation. For all other disputes, you agree to first attempt to resolve the dispute informally by contacting us at legal@dotwee.com.

18.3 Jurisdiction. If informal resolution fails, any legal action shall be brought exclusively in the courts of Hong Kong, and you consent to the personal jurisdiction of such courts.

19. General Provisions

19.1 Entire Agreement. These Terms, together with our Privacy Policy, Abuse Policy, and other policies referenced herein, constitute the entire agreement between you and DotWee regarding our services.

19.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

19.5 Notices. Notices to you will be sent to the email address associated with your account. Notices to us should be sent to legal@dotwee.com or by mail to our registered address.

19.6 Language. These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
